Halle Berry’s custody war stretched into a second week — and her ex’s own signature became the biggest witness against him.
Five days into Halle Berry’s custody hearing, the biggest witness against Olivier Martinez turned out to be Olivier Martinez.
Thursday, under cross-examination, Martinez confirmed he’s now alleging Berry abused HIM across their relationship — incidents going back a decade. Then Berry’s lawyer produced a declaration he signed under penalty of perjury on September 30, 2024: “There is no history of domestic violence between the parties.”
She asked if the signature was his. “Correct.” Was it true when he signed it? “Correct.”
His lawyer says that filing was about attorney’s fees, not custody. Maybe. But a signature under oath isn’t a rough draft. One of those two statements is false, and a judge is going to decide which one — while deciding where their 13-year-old son lives.
The rest of the week, quickly: Maceo testified nearly four hours Monday in a sealed courtroom — nobody outside that room knows what he said, and anybody who claims to is guessing. Berry says the September incident Martinez calls abuse was roughhousing; he says it was worse. A restraining order still limits her to daytime visits. Friday was day five: Martinez kept testifying behind closed doors, her fiancé Van Hunt took the stand the same way, and the judge extended the restraining order through the weekend. No ruling yet — the hearing resumes Monday, when her daughter Nahla is expected to testify virtually. (Reports that Martinez “stormed out” Tuesday were denied by his lawyer — TMZ says it was a bathroom break the judge approved.)
Underneath all of it sits the math from their 2023 settlement: she pays him $8,000 a month plus 4.3% of everything she earns over $2 million, plus all tuition, activities, and health care. His obligation: make “reasonable efforts” to find work.
Whatever the judge decides about that September night, understand what custody means in this case. Custody is the check. It always was.
Two people signed a story about their marriage. Only one of them signed it twice — differently.
