A Los Angeles judge denied Olivier Martinez’s request for a domestic violence restraining order against Halle Berry on Thursday, dissolved the temporary restraining order granted October 1, and left primary physical custody of their 13-year-old son Maceo with Martinez — temporarily. The ruling is not final. A further hearing is set for November 4.
Martinez had sought the restraining order and sole custody, alleging Berry choked him on September 26. Berry denied the allegation and asked the court to dismiss the restraining order request, grant her sole legal custody over education and medical decisions, and restore 50-50 physical custody.
The restraining order fight went Berry’s way. The request was denied, the October 1 TRO was dissolved, and Berry’s attorney said afterward the team was “extremely pleased that the Court has dissolved the TRO.”
The custody fight stayed with Martinez, for now. He keeps primary physical custody under the arrangement already in place, and Berry’s requests to restore 50-50 custody and add overnights were denied on a temporary basis — zero overnights for now. Legal custody stays joint, not sole: Berry did not get sole legal custody over education and medical decisions. According to her attorney, as reported by secondary outlets, she retains joint legal custody with tie-breaking authority.
Martinez’s request for sole holiday custody was also denied. Berry’s holiday visits stay intact.
On money, nothing changed. No new support order was reported. The $8,000 a month from the 2023 divorce stands.
One term was reported by a single outlet: Hello Magazine alone reported that the court ordered therapy. No other outlet in this check reported that term.
The background: the September 26 allegation, the October 1 TRO, and an October 26 “disrespect” post on Berry’s Instagram that her team claims was the work of a hacker, not her. The hearing was before Judge Shelley Kaufman in L.A. Superior Court. Both parents are 60. Maceo is 13.
Until November 4, the temporary arrangement stands.
